You and your means the user of australia.gov.au, any SmartForm or an australia.gov.au Account.
Our, us and we means the Commonwealth of Australia represented by the Department of Finance and Deregulation.
- These Account terms and conditions apply in addition to the terms of use for australia.gov.au.
- You may choose not to use the australia.gov.au Account service if you wish.
The australia.gov.au Account service
- To create and use the australia.gov.au Account you must accept and comply with these Account terms and conditions.
- We may make changes to the Account services at any time. If this happens, you will be asked to accept the new terms and conditions.
- You may close your australia.gov.au Account online at australia.gov.au. If you do not access Your australia.gov.au Account for eighteen (18) months, your australia.gov.au Account will be closed. If your australia.gov.au Account is closed, we will delete the information you provided, including your secret questions and answers. Closure of your australia.gov.au Account will not affect your access to other Participating Agency online accounts.
- If your australia.gov.au Account is not available for any reason, you can communicate directly with the relevant Agency, for example by telephone, in person or through their website.
- Having an australia.gov.au Account does not:
- affect or reduce any obligation owed to you by any Agency; or
- reduce any obligation you owe to any Agency.
Your responsibilities
- You must:
- keep your australia.gov.au Account user ID, password and your secret questions and answers secure at all times;
- not permit any other person to use your user ID and password; and
- change your password regularly and when prompted.
- You should use appropriate and up-to-date firewall and anti-virus software to protect your computer systems.
Our responsibilities
- If the australia.gov.au Account terms and conditions change, we will ask you to accept the new terms and conditions. If you choose not to accept the terms and conditions, we will close your australia.gov.au Account.
- We have responsibilities relating to the security and privacy of your australia.gov.au account information and transactions.
- We will use all reasonable endeavours to ensure that your information is not corrupted or changed. We have implemented a number of mechanisms for achieving this.
- We will take reasonable care in providing the information and services through the australia.gov.au website. However, we cannot accept liability for all possible Losses that could arise as a result of your use of australia.gov.au, including your australia.gov.au Account. If a problem or loss is caused by the information you included your australia.gov.au Account or because your computer was compromised in some way, we cannot take responsibility for causing the problem. We will, however, do our best to help you if we can.

- We will only use and disclose your personal information to a person, body or other Agency:
- as permitted by these australia.gov.au Account terms and conditions;
- to provide you with a service that you have requested;
- as authorised by law, for example, if a law enforcement authority or court order lawfully directs us to disclose the information of a user of australia.gov.au.
- We may collect personal information from you to provide you with the australia.gov.au Account services. You are not obliged to provide the information.
- You may update and correct your personal information at any time by logging into your australia.gov.au Account.
General
- These australia.gov.au Account terms and conditions do not negate any terms or conditions of use of any other government Agency website.

Definitions
Loss means loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue.
Participating Agencies are Commonwealth of Australia agencies that are working with us to deliver the australia.gov.au service to you.
