Terms and Conditions - SmartForm Service

You and Your means the user of the australia.gov.au SmartForm Service.

Our, us and we means the Commonwealth of Australia represented by the Department of Finance and Deregulation.

  1. The australia.gov.au SmartForm Service allows you to submit information electronically to various Participating Agencies. To submit a SmartForm, you must agree to these SmartForm Service terms and conditions. Please note that any terms and conditions recorded on the SmartForm itself and the australia.gov.au terms of use may also apply.

Your responsibilities

  1. To protect your privacy, we have purposely designed the system so only you have control over what information is entered in the form. It is your responsibility to check the information you include on a SmartForm – including any information you pre-populate from your australia.gov.au Account – and correct any errors before You submit the SmartForm.
  2. If you save a SmartForm on your own computer or somewhere outside our system, you must make sure the SmartForm is stored securely. Because we do not have any control over forms stored outside our system, we cannot accept any responsibility for them.
  3. You will add to the security of a SmartForms transaction by using up-to-date firewall and anti-virus software to protect your and our computer systems.

Our responsibilities

  1. We are responsible for the security and privacy of your SmartForm during transit and while stored in the SmartForm system.
  2. We will use all reasonable endeavours to ensure that once you have submitted a form it is not corrupted or changed. We have implemented a number of mechanisms for achieving this.
  3. We will provide you with a receipt when you successfully submit a SmartForm using the australia.gov.au SmartForm Service.
  4. If a problem or loss is caused by the information you included in a SmartForm or because your computer was compromised in some way, we cannot take responsibility for causing the problem. We will, however, do our best to help you if we can.

Privacy

  1. For more information about how we protect your privacy and personal information, please see our privacy statement.
  2. We have designed the SmartForm Service so that only the recipient Agency will be able to view the content of your completed SmartForm.
  3. We will not keep your completed SmartForm. We will collect information regarding the SmartForm name, the time and date that the SmartForm is submitted using australia.gov.au for audit and evidentiary purposes.
  4. You agree and acknowledge that the information you submit via a SmartForm may be retained by the Agency to which the SmartForm is submitted.

General

  1. These SmartForm Service terms and conditions do not negate any terms or conditions of any Agency in relation to their Agency website.
  2. Please contact us if you have any questions, problems or feedback regarding the SmartForm Service.

Definitions

Loss
Loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue.
Participating Agencies
Commonwealth of Australia agencies that are working with us to deliver the australia.gov.au service to you.

  • We use our best endeavours to ensure that once your completed SmartForm is in our system it is not corrupted or changed. Our system has a number of mechanisms for achieving this.
  • If we find that a problem is caused by the information you included in a SmartForm or because your computer was compromised in some way, we cannot take responsibility for causing the problem.
